A. Introduction

This Privacy Policy applies to the lifeworkstore.id website and when you share your Personal Data with us through our in-store subscriptions or via other voluntary means in Indonesia. It explains how we may collect, use and disclose your Personal Data, including our obligations and your rights in respect of our dealings with your Personal Data, consistent with our commitment to providing you with a satisfactory and helpful shopping experience.

Please read this Policy carefully. By visiting the Site and/or using the products and services made available to you through the Site, you are agreeing to this Privacy Policy which shall apply to all information that we have about you, and that any dispute over privacy is subject to this Privacy Policy and our Site’s Terms and Conditions. LifeWork Indonesia takes its responsibilities in relation to protecting your Personal Data and compliance with Applicable Laws very seriously. 

Next, we will further explain the laws and regulations applicable to the management of personal data.

The LifeWork Indonesia Platform reserves the right to update this Privacy Policy from time to time to remain relevant and current with changing technology, applicable laws, evolving business practices of the LifeWork Indonesia Platform, and the needs of LifeWork Indonesia users. If any changes are made to this Privacy Policy, the LifeWork Indonesia Platform will provide a “Last Updated” date. The LifeWork Indonesia Platform encourages users to periodically review this Privacy Policy to stay informed about how the LifeWork Indonesia Platform manages users' data and personal information. By using the Services and Platform, users are deemed to give explicit consent to this Privacy Policy, and by continuing to use the Services and/or Platform, users are considered to have read, understood, and agreed to the updated Privacy Policy as it changes over time.

THIS PRIVACY POLICY CONSTITUTES A FORM OF AGREEMENT THAT IS A BINDING CONTRACT BETWEEN USERS AND THE LIFEWORK INDONESIA PLATFORM. USERS CONSENT TO THESE TERMS VOLUNTARILY AND AWARELY IN ORDER TO USE THE SERVICES ON THE LIFEWORK INDONESIA PLATFORM.

B. Laws and Regulations

The LifeWork Indonesia Platform is subject to all applicable laws and regulations of the Republic of Indonesia, including those governing electronic information and transactions, the operation of electronic systems, and the protection of users' personal data. This includes all implementing regulations and amendments to such regulations that govern and protect the use of users' important data and information.

C. Data Acquisition and Protection

  1. The LifeWork Indonesia Platform has the right to request users' data and information, including but not limited to:

    • Information related to the LifeWork Indonesia Account: (i) Name (ii) Email

    • User behavior on the LifeWork Indonesia Platform and/or while using the Services through the Platform, along with product choices, features, and other Services (“Transaction Data”), including but not limited to: (i) User preferences and interests (ii) User experience information (iii) Survey results sent by the LifeWork Indonesia Platform or on behalf of the LifeWork Indonesia Platform (iv) User log data, including but not limited to device IP address, date and time of access, pages viewed on the Platform, other system activities, browser type, and/or third-party sites used before interacting with the site (v) Other user information, including but not limited to registration activities, logins, transactions, and others.

    • Information from third parties: (i) User information obtained from third parties collaborating with the LifeWork Indonesia Platform, such as vendors, agents, professional advisors, consultants, and others may be collected in connection with third-party involvement. (ii) The LifeWork Indonesia Platform may receive information about users from third parties as long as the user has given consent to provide the necessary (relevant) information.

  2. By providing information as outlined in sections 1.1 to 1.3 above, users waive any rights to claims, losses, demands, and lawsuits that may arise regarding the acquisition, storage, use, utilization, and/or disclosure of information, including personal information, within the Platform.

  3. Users hereby give explicit consent to the LifeWork Indonesia Platform to obtain, collect, process, analyze, store, display, use, utilize, publish, transmit, disclose, disseminate, delete, and destroy the personal data and information they submit (input) into or perform on the Platform. Users declare that this consent is given voluntarily, competently, and with awareness, as this consent is provided while using the Services or Platform (“User Consent”).

  4. Based on User Consent, users declare that all their data on the Platform belongs to the LifeWork Indonesia Platform. To avoid doubt, user data, whether entered into the Platform or not, is owned by the user as part of their complete personal rights.

  5. Users declare that the personal data they submit (input) into the LifeWork Indonesia Platform (including documents uploaded and/or provided to the LifeWork Indonesia Platform) is original, authentic, true, accurate, complete, not misleading, up-to-date, and that they have the right to provide this personal data to the Platform.

  6. The LifeWork Indonesia Platform protects all information provided by users when they use all Services and/or the Platform, including maintaining the confidentiality, integrity, and availability of the personal data it manages.

  7. The LifeWork Indonesia Platform has the right to request authentication and updating of users' personal data from time to time, ensuring that users' data and information are accurate, complete, and up-to-date. This may include temporarily suspending Services and/or permanently terminating Services if users have not authenticated and updated their personal data.

  8. Users have the right to update their personal data from time to time.

  9. Users understand that utilizing certain features within the LifeWork Indonesia Platform requires further authentication of personal data and is subject to the LifeWork Indonesia Platform's Terms of Use and specific terms and conditions of those features. Users reaffirm that User Consent is explicit consent for the acquisition, collection, storage, processing, use, analysis, utilization, publication, display, transmission, dissemination, disclosure, deletion, and/or destruction of the personal data they submit (input) into the Platform and specific features, and that this consent is given voluntarily, competently, and with awareness.

  10. Users release the LifeWork Indonesia Platform from all claims, legal demands, losses, and/or demands related to the failure of transaction processing in the system or Platform caused by inaccuracies/inadequacies in the personal data provided by the users to the LifeWork Indonesia Platform.

D. Use, Storage, Utilization, and Processing of Data

The LifeWork Indonesia Platform will collect, use, store, utilize, process, analyze, transmit, and disclose users' Personal Data to third parties for the following purposes and other purposes permitted by applicable laws and regulations:

  1. Service Processing Provided by the LifeWork Indonesia Platform.

    This includes, among others: (i) internal data processing, (ii) communicating with users regarding products and services, as well as promotional offers, (iii) monitoring and understanding user communication patterns, (iv) activating, providing, maintaining, supporting, troubleshooting, deactivating, replacing, upgrading, or renewing Services, (v) administrative purposes, (vi) processing any user activity including but not limited to transaction processing, payment verification, and service usage, (vii) managing or responding to user inquiries, (viii) using bank name information, including name and account number, to ensure payments by users, (ix) to fulfill or enforce notices applicable to the Services.

  2. Providing, Troubleshooting, and Improving LifeWork Indonesia Services.

    The Platform uses users' Personal Data to (i) provide functionality, analyze performance, correct errors, and enhance the usability and effectiveness of the Services, (ii) ensure that the Services operate technically as intended and to help identify and resolve issues.

  3. Recommendations and Personalization.

    The Platform uses users' Personal Data to recommend features, products, and services that may be of interest to users, to better understand, analyze, and predict users' preferences and interests, combine this information with other information to tailor the user experience, and personalize users' experiences with the Services.

  4. Compliance with Legal Obligations.

    In certain cases, the LifeWork Indonesia Platform collects and uses users' Personal Data to comply with laws, regulations, and respond to emergencies. For example: (i) to respond to court orders, summons, or legitimate requests or legal processes or other law enforcement actions, (ii) requests or official orders from authorities or institutions based on applicable legal provisions, including but not limited to disputes, investigations, inquiries, legal processes, and dispute resolution processes between the LifeWork Indonesia Platform and users, users and Product Providers/Partners/Suppliers, and users and other parties, as well as other illegal activities, (iii) requests from banks, financial institutions, or authorized non-financial institutions, and/or third parties based on official requests and applicable legal provisions, (iv) to provide emergency assistance in situations that may threaten the life, health, or physical safety of users or others.

  5. Communication with Users.

    The Platform uses users' Personal Data to communicate with users regarding the Services through various channels (e.g., via phone, email, chat).

  6. Advertising, Promotion, and Personalization.

    The Platform uses users' Personal Data to (i) display or conduct promotional activities and interest-based advertising for features, products, and services that may interest users, including but not limited to advertising identifiers, including those provided by other software platforms, or similar identifiers, to assist the LifeWork Indonesia Platform in conducting analytics or providing promotional content or other information that may be relevant and interesting to users, (ii) to facilitate user access and use of the Services and/or third-party offers; (iii) to send subscription offers, messages, news, and posts within the Services on behalf of the LifeWork Indonesia Platform.

  7. Fraud Prevention, Money Laundering, and Credit Risk.

    The LifeWork Indonesia Platform uses users' Personal Data to prevent and detect fraud and money laundering and abuse to protect the security of users, the LifeWork Indonesia Platform, and others. The Platform may also use assessment methods to evaluate and manage credit risk.

  8. Developing Services.

    The LifeWork Indonesia Platform uses users' Personal Data to develop new services and enhance existing Services, providing users with information about third-party content or related products, services, and software, including communicating with users about various methods they use, for example, to provide or send to users: (i) enhancements or updates, or notifications about enhancements or updates from the Services or third-party content or related products, services, and software; (ii) promotional notifications, contests, offers, and upcoming events; (iii) personal information, surveys, marketing materials, advertisements, or customized content. Also for purposes (i) to detect, monitor, investigate, mitigate, or prevent fraud and technical or security issues or to protect the property of the LifeWork Indonesia Platform; (ii) to enable business continuity and disaster recovery operations; (iii) to obtain legal services, seek legal advice, and/or enforce the legal rights of the LifeWork Indonesia Platform or the legal rights of other members of the LifeWork Indonesia Platform; (iv) for statistical purposes; (v) business development, products, quality, and services including promotional activities, studies, research, and collaboration with other third parties.

  9. If necessary for a clear purpose in the interest of the User and User Consent cannot be obtained in a timely manner.

  10. Other purposes communicated from time to time by the LifeWork Indonesia Platform to Users, as well as those required, permitted, or mandated by applicable laws and regulations.

The LifeWork Indonesia Platform may collaborate with companies and other third parties that facilitate or provide assistance in the development of certain services for and/or on behalf of LifeWork Indonesia, including:

  • Providing assistance to Users;
  • Carrying out services related to the Platform (including but not limited to maintenance services, database management, analysis, and enhancement of Platform features);
  • Assisting LifeWork Indonesia in analyzing how the Platform Services are used and how they are developed;
  • Helping professional advisors and external auditors of LifeWork Indonesia, including legal advisors, financial advisors, and consultants. These third parties will only have access to User Data to perform these tasks for and/or on behalf of LifeWork Indonesia and are contractually bound not to disclose or use that Personal Information for any other purposes.

In the disclosure of information, LifeWork Indonesia may inform part of the User Data so that the information becomes non-identifiable as a whole (aggregate/anonymous data) intended for third parties used for Platform development, database management, analysis, or Service enhancement, promotion, and advertising.

LifeWork Indonesia may also combine User Data with other information in such a way that the information is no longer associated with the User, and then disclose the combined information to third parties for purposes similar to those in point 3.

For the purposes of developing, enhancing, refining, protecting, and maintaining products and/or Services, LifeWork Indonesia may be required to process, utilize, display, disclose, publish, transmit, transfer, and/or disseminate Personal Data to third parties. To avoid doubt, the third parties referred to in this paragraph may include, but are not limited to:

  • Third parties within the group of companies, subsidiaries, affiliates, partners, and vendors of LifeWork Indonesia for purposes related to providing the Platform, managing business, delivering Services, managing data, and other activities;
  • Interests of LifeWork Indonesia, its affiliates, group companies, and subsidiaries for business development, products, quality, and services, including promotional activities, studies, research, and collaboration with other third parties;
  • Interests of LifeWork Indonesia to fulfill transaction purposes, including the sale of all or part of its assets, any purchases, sales, leases, mergers, amalgamations, acquisitions, disposals, or financing of LifeWork Indonesia, its affiliates, subsidiaries, and group companies;
  • Third parties in connection with corporate transactions, such as forming joint ventures, restructuring, reorganizing, selling subsidiaries or divisions, mergers, acquisitions, consolidations, takeovers, asset sales, or liquidations;
  • Other third parties (including agents, vendors, suppliers, contractors, and third parties providing services to LifeWork Indonesia or Users) that perform tasks on behalf of LifeWork Indonesia and engage in commercial collaboration, which may involve allowing third parties to introduce or offer products or services to Users or conduct other activities such as marketing, research, analysis, and product development, depending on the circumstances.

LifeWork Indonesia Platform will retain Personal Data as long as necessary to fulfill the purposes described in this Privacy Policy.

The Platform may contain links to third-party sites. The LifeWork Indonesia Platform is not responsible for the acquisition, collection, processing, analysis, use, storage, display, announcement, transmission, dissemination, deletion, and destruction of User Personal Data by such third parties. If Users provide information directly to a site, then the privacy policy and terms of service at that site will apply, and any consequences of such actions are the sole responsibility of the Users.

The LifeWork Indonesia Platform, its affiliates, group companies, and subsidiaries, including representatives of the LifeWork Indonesia Platform, and third parties collaborating with the LifeWork Indonesia Platform, in providing Services have the right to utilize and process User personal data to fulfill the purposes of the Services, the purposes of this Privacy Policy, and the purposes of applicable laws and regulations. The utilization and processing of such data are covered by agreements and contain confidentiality clauses binding the parties, including representatives of the LifeWork Indonesia Platform.

The LifeWork Indonesia Platform may transfer User Personal Data to affiliated platforms or service providers of the LifeWork Indonesia Platform or to third-party recipients. Therefore, by using the Services or the LifeWork Indonesia Platform, Users also consent to the transfer of Personal Data to affiliated platforms or service providers of the LifeWork Indonesia Platform or to third-party data recipients for the development of services, whether technical, commercial, or otherwise. Wherever User Personal Data is transferred, stored, or processed by the LifeWork Indonesia Platform or affiliated platforms or third parties, or other service providers of the LifeWork Indonesia Platform, the LifeWork Indonesia Platform will take reasonable steps to protect the privacy of User Personal Data.
